LED 台廠宏齊科技近日於美國時間 2016 年 1 月 26 日，委託美國律師事務所 Devlin Law Firm LLC，於美國加州中區聯邦地方法院，控告美國 LED 大廠科銳（Cree）侵害其一項專利，該白光 LED 相關專利號為 US 6,841,934。
先前科銳曾於 2014 年 9 月 15 日對台廠宏齊發動專利訴訟，宏齊立即展開反擊，不僅於 2014 年 12 月 5 日在美控告科銳及旗下子公司侵犯專利權，又於 2015 年 7 月在法律攻防場合上，成功使科銳旗下相關中國專利無效。
此次宏齊再度於美國提起訴訟的專利與 LED 封裝有關。宏齊表示，公司在該技術投入大量研發資源，擁有可觀的專利組合，絕對有能力捍衛其客戶及股東的權益。宏齊認為，透過這些 LED 訴訟反擊，顯示宏齊的專利實力及應訴能力，已經足以與國際大廠抗衡。
截至目前為止，雙方訴訟仍在進行當中，宏齊對於訴訟進展表示審慎樂觀。
LEDinside 觀察，該專利項目重點：「A white light source is obtained by converting short wavelength color light emitted from a light emitting diode (LED). The conversion is achieved by covering the LED chip with a fluorescent glue. The LED chip is mounted on a split substrate, and the outer ends of the substrate serve as terminals for the LED. A wall may be erected around the LED chip to contain the fluorescent glue, and another transparent glue may be used to cover the fluorescent glue for protection.」主要用於白光 LED 封裝上，為螢光粉與 LED、基板封裝結構。
其實科銳自 2014 年以來，已對許多台灣 LED 封裝廠商興訟，而市場上也有不少台灣 LED 封裝廠與宏齊的態度和立場類似，會傾向繼續與科銳在法律上對抗。
